Резюме: ты неправ в обеих темах. Код шаблона должен быть под GPL, всё остальное: медиа / разметка (в том числе внутри шаблона) - под чем угодно.
п.с. И перестань называть лицензию "GNU". GNU расшифровывается как "GNU is not Unix", это акроним. Лицензия называется GNU/GPL или просто GPL.
п.п.с. Лицензия GNU/GPL распространяется только на код, почитай её содержимое. Фотографии под её действие никак не могут попасть.
