312. CIVILIANS
1. Civilians are non-combatants. As a general rule, they may not be attacked unless they participate
directly in hostilities.

318. CIVILIANS ENGAGED IN HOSTILITIES
1. Civilians who take a direct part in hostilities (other than a levée en masse) are unlawful combatants.
They lose their protection as civilians and become legitimate targets for such time as they take a direct part
in hostilities.

2. If captured, civilians who take a direct part in hostilities are not entitled to PW status, but they must
nevertheless be treated humanely. They may also be punished as unlawful combatants but only following a
fair trial affording all judicial guarantees.

320. SPIES
1. Espionage means to gather or attempt to gather information of military value through an act of false
pretence or deliberately in a clandestine manner. Generally speaking, persons engaging in espionage may
be attacked and if captured while doing so shall NOT have the right to the status of prisoner of war.
